Pre-Litigation Settlement Scenario:
A male employee over the age of 40 suffered from a disability, a heart condition, and was employed as a salaried manager of a company. When he was told not to return to work a few weeks after an emergency heart operation, he rushed back to work. During his last few weeks of work, the employee claimed he was suddenly being treated differently than he was before his operation. He alleged that in the last few weeks he was ridiculed, singled out, and forced not to return. Upon consultation with counsel, he successfully negotiated a separation agreement based on his legal claims. No legal action was filed.
