Under California Government Code § 12950.1, employers with five or more employees must provide sexual harassment prevention training every two years.

Requirements include:

  • Two hours of training for supervisors
  • One hour of training for non-supervisory employees
  • New supervisors must be trained within six months of assuming supervisory duties
  • New non-supervisory employees must be trained within six months of hire

Training must be interactive and include practical examples. It must also address harassment based on gender identity, gender expression, and sexual orientation.

Employers should maintain written records of completed training. In California harassment litigation, lack of compliant training frequently weakens the employer’s defense.
