Final wage payment timing is strictly regulated under Labor Code §§ 201–203.
- If an employee is terminated, all wages are due immediately at the time of termination.
- If an employee resigns with at least 72 hours’ notice, final wages are due on the last day worked.
- If the employee resigns without notice, final wages must be paid within 72 hours.
Late payment can trigger “waiting time penalties,” which accrue at the employee’s daily rate for up to 30 days.
